Terms of Service

Welcome to Vêtu. By accessing or using our wardrobe management application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Vêtu ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Service after changes constitutes acceptance.

You must be at least 13 years of age to use Vêtu. By creating an account, you represent and warrant that:

• You meet the minimum age requirement
• All information you provide is accurate and current
• You will maintain the security of your account credentials
• You will not share your account with others

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate profile information (username, measurements, preferences)

Free Plan

The Free plan includes basic wardrobe digitization, AI auto-tagging, and access to your digital closet. Free accounts are limited to 30 items and do not include premium features such as outfit generation, wear analytics, or gap analysis.

Pro Plan

Pro subscriptions unlock unlimited items, daily outfit recommendations, smart cooldown tracking, cost-per-wear analytics, and AI-powered shopping suggestions. Current pricing: $4.99/month (limited-time discount from $6.99).

Payment Processing: Payments are processed securely through Stripe. By subscribing, you authorize recurring monthly charges to your payment method.

Refund Policy: We offer refunds within 7 days of your initial subscription charge if you are not satisfied with the Service. Refunds are not available for renewal charges. Contact us at support@vetu.app to request a refund.

Cancellation: You may cancel your subscription at any time through the app settings. Upon cancellation, you retain Pro access until the end of your current billing period, after which your account reverts to the Free plan.

You retain all ownership rights to content you upload to Vêtu, including photos of clothing items ("User Content"). By uploading content, you grant us a limited, non-exclusive license to:

• Store and display your content within the Service
• Process images using AI to generate tags, colors, and categories
• Use aggregated, anonymized data to improve our algorithms

We will never: Sell your photos to third parties, use your images for advertising without consent, or share your wardrobe publicly unless you explicitly enable social features.

Vêtu uses Google Gemini AI to analyze clothing images and generate outfit recommendations. While we strive for accuracy, AI suggestions are not guaranteed to be perfect. You acknowledge that:

• AI-generated tags (brand, color, style) may contain errors
• Outfit recommendations are subjective and for inspiration only
• Gap analysis suggestions are educational, not professional styling advice
• We are not responsible for purchasing decisions based on AI recommendations

Fair Use: Free users receive a limited number of AI scans per month. Excessive or automated scanning may result in rate limiting or account suspension.

You agree not to use Vêtu to:

• Upload copyrighted images you do not own (e.g., brand lookbooks, editorial photos)
• Scrape, reverse-engineer, or extract data from the Service
• Use automated tools or bots to interact with the platform
• Upload offensive, obscene, or illegal content
• Impersonate others or create fake accounts
• Resell or redistribute access to the Service
• Attempt to bypass subscription restrictions or trial limitations

Violation of these terms may result in immediate account termination without refund.

Vêtu's branding, design, software, and AI algorithms are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our software or design elements
• Use our trademarks ("Vêtu," logo) without written permission
• Create derivative works based on our Service

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms or our Privacy Policy
• Fraudulent payment activity
• Abusive behavior toward our team or other users
• Inactivity exceeding 2 years (with prior notice)

Account Deletion: You may delete your account at any time through app settings. Upon deletion, all your data (wardrobe items, photos, profile information) will be permanently removed within 30 days. Active subscriptions will be canceled, but no refunds will be issued for partial billing periods.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that the Service will be error-free, uninterrupted, or secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability: In no event shall Vêtu be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, revenue, or profits, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Vêtu and its affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your User Content infringing on third-party rights
• Your use of the Service in a prohibited manner

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution: Before filing a claim, you agree to contact us at legal@vetu.app to attempt to resolve the dispute informally.

Arbitration: Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the American Arbitration Association's rules. You waive your right to a jury trial or class action lawsuit.

Vêtu integrates with third-party services including:

• Supabase: Database and authentication
• Google Gemini AI: Image analysis and recommendations
• Stripe: Payment processing
• Unsplash: Demo imagery (not user data)

Your use of these services is subject to their respective terms of service. We are not responsible for the practices or policies of third-party providers.

We may update these Terms periodically. Significant changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
